I represent individuals in Chapter 7 and Chapter 13 bankruptcies. I have personally represented more than 700 individuals in personal bankruptcies in the United States Bankruptcy Court for the Eastern District of Pennsylvania as well as the United States Bankruptcy for the District of New Jersey.
A Chapter 7 Bankruptcy is usually called a "liquidation." However, most people have assets that are well below the exemptions provided by the United States Bankruptcy Code. Therefore, most people who qualify and file for Chapter 7 Bankruptcy are able to keep all of their assets.
A Chapter 13 Bankruptcy is normally called a repayment plan. This is for people that have fallen behind on their mortgage, rent or car loan and they need time to pay back the amount that they are behind. A Chapter 13 Plan allows a repayment period of 36 months to 60 months for a person to pay back the amount that they are behind. In addition, if a person does not qualify for Chapter 7, usually because of higher than normal income, then that person may file a Chapter 13 in order to pay their creditors without the threats of lawsuits, bank levies, etc. In addition, a Chapter 13 allows a person that is behind on his/her income taxes to the IRS to pay any back taxes through his/her Chapter 13 repayment plan.
